The Legal Advisory Commission of the Community of Madrid has given the green light to the City Council of San Martín de la Vega to terminate the contract with the contractor that abandoned the work. The council will retain the guarantee and is preparing a new project.
The Legal Advisory Commission of the Community of Madrid has endorsed the decision of the City Council of San Martín de la Vega to terminate the contract for the renovation of the Glorieta San Marcos park. The ruling, dated 25 August 2026, concludes that the contractor Instalaciones Madrileñas Secis, S.L. committed a culpable breach by abandoning the work.
The report establishes that the company "not only delayed compliance with the deadlines but also abandoned the work," according to the construction visit records from May 2026 and the contractor's own statements. This ruling is a necessary step prior to the definitive resolution of the contract, according to the Public Sector Contracts Law.
The mayor, Rafael Martínez, explained that the council can now finalize the file and initiate a new one with a project that "we are finalizing in order to resume the park works as soon as possible." Martínez defended that "throughout the procedure we have acted correctly and demanded the contractual obligations that have been evidenced as breached."
The Commission also supports that, since it is a culpable breach, the contractor must compensate for the damages, and that the compensation should be made effective "firstly, against the guarantee." The City Council has announced that it will retain the guarantee deposited by the company, without prejudice to opening a contradictory procedure to claim damages caused by the abandonment of the work.
We will not spare any effort in taking all necessary measures to claim the damages we have suffered," said the mayor, who added that "we will continue working to ensure the completion of this important project for the improvement of the urban environment.
The residents of San Martín de la Vega hope that the new project will allow the works, which were halted after the contractor's abandonment, to resume as soon as possible. The City Council is working on drafting the new plan to re-tender the work.
